Telephone Consumer Protection Act (TCPA) Prohibits Harassing Calls for By Debt Collectors

In 1991, the United States Congress passed the Telephone Consumer Protection Act (TCPA) into law in order to crack down on telemarketing, spam phone calls, robocalls, and other related abusive debt collection practices. The TCPA provides important legal protections to consumers. Under the statute, debt collectors must follow strict rules and regulations when calling consumers. Here are three key things to know about your rights under the TCPA:

  1. Debt collectors can only call consumers between the hours of 8:00 AM and 9:00 PM;
  2. Debt collectors cannot use artificial or prerecorded voice messages, but for in emergency situations or with the permission of the recipient; and
  3. Debt collectors must maintain a ‘Do Not Call’ list and allow people to be placed on that list upon request.

Notably, the TCPA provides individual consumers with a ‘private right of action’—meaning you can file a lawsuit directly against any creditor, debt collector, or other company that violates your rights under the law. You can seek damages for up to $500 for each TCPA violation. The amount of damages increases to $1,500 per violation if you can prove that the company “knowingly and willfully” breach the law.
